Terms of Use
1. Who you are agreeing with
These Terms of Use ("Terms") are an agreement between you and Steven Kippax, trading as Thier, a sole-trader business based in Glasgow, United Kingdom ("Thier", "we", "our", "us"). They govern your use of the Thier iPhone application, the Thier marketing site at thier.app, the public web mirror (lessons, posts, profiles, clubs, events), the AI features, the social and community features, and any other Thier-branded service (together, the "Service").
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Health and medical disclaimer
The "AI Longevity Doctor" / "AI Coach" feature is a software assistant. It is not a doctor, has not examined you, does not have access to your full medical history, and may produce inaccurate, incomplete, or outdated information. Treat its output as a starting point for a conversation with your own clinician, not as medical advice.
Biological-age estimates and what-if simulations are wellness signals, not clinical diagnoses or mortality predictions. They are inherently uncertain and should not be relied on for clinical decisions.
3. Beta product status
Thier is offered as a private or limited beta. Beta features may change, break, be delayed, or be withdrawn without notice. Access is not guaranteed, and joining the waitlist does not guarantee admission. We may move features in or out of paid tiers as the product matures.
4. Eligibility and your account
You must be 18 years of age or older to create a Thier account. You are responsible for keeping your account credentials and the device you sign in on secure, and you are responsible for activity that occurs under your account.
We may suspend, restrict, or terminate access if there is suspected abuse, misuse, security risk, content moderation issue, or breach of these Terms.
5. Acceptable use
You will not, and will not encourage anyone else to:
- misuse, probe, or try to disrupt the Service or its underlying infrastructure
- scrape, copy, resell, or redistribute Thier content without our permission
- use the Service to infringe another person's rights or break the law
- upload material that is unlawful, harmful, abusive, defamatory, hateful, sexual content involving minors, or that infringes copyright or intellectual property
- impersonate another person, misrepresent affiliation, or use a fake or misleading identity
- use the AI features to attempt to obtain prescription, dosing, or other regulated clinical advice as a substitute for a clinician
- use the Service for emergency or urgent medical decision-making
6. User-generated content
You retain ownership of content you submit (posts, comments, profile content, messages, images, GIF picks). You grant Thier a worldwide, non-exclusive, royalty-free licence to host, display, distribute, and reformat that content as needed to run the Service (e.g. render your public posts on thier.app, deliver your messages to recipients).
You confirm that you have the rights to post any content you submit, that the content is yours or that you have the necessary permissions, and that the content does not infringe anyone else's rights.
We reserve the right (but do not promise) to review, remove, or restrict content that breaches these Terms, and to suspend the responsible account.
7. Notice and action: copyright and other complaints
If you believe content on Thier infringes your copyright or other rights, or otherwise breaches these Terms, send a notice to founder@thier.app including:
- your name and contact details (email is fine)
- identification of the work or right that you say is being infringed (with a link or copy if available)
- identification of the material on Thier you are complaining about, with enough detail for us to find it (URL, post id, etc.)
- a statement that you have a good-faith belief the use is not authorised
- a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the rights-holder or authorised to act on the rights-holder's behalf
- an electronic or physical signature
We will respond promptly. If we remove material in response to such a notice, we will, where appropriate, provide the uploader with a copy of the notice and an opportunity to counter-notify. This procedure is intended to comply with the notice-and-takedown framework under 17 U.S.C. § 512 (DMCA) for US users, the EU Digital Services Act Article 16 for EU users, and the UK Online Safety Act for UK users. Repeat infringers will have their accounts terminated.
8. Subscriptions and payments
Paid plans, including any free trial, are sold and billed by Apple via the App Store. Billing, renewal, cancellation, and refund handling are subject to Apple's own terms and platform rules. Manage or cancel subscriptions in your Apple account settings: apps.apple.com/account/subscriptions.
What we disclose at the paywall
- Free trial length: 7 days, unless stated otherwise on the paywall.
- Post-trial price and billing frequency: shown on the paywall in your local currency, billed monthly or annually depending on the plan you select.
- Auto-renewal: subscriptions renew automatically at the price displayed on the paywall, until you cancel. Apple will charge the payment method on file at the start of each new period.
- How to cancel: at least 24 hours before the end of the current period, in your Apple account settings (linked above). Cancellation takes effect at the end of the current paid period.
- Where to find these Terms and our Privacy Policy: directly from the paywall, the in-app Profile tab, and at thier.app/terms and thier.app/privacy.
EU / UK 14-day right of withdrawal
If you are a consumer in the EU or UK, you have a 14-day right to withdraw from a distance contract under the EU Consumer Rights Directive (Article 9) and the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You can exercise this right by cancelling your subscription in your Apple account settings within 14 days of purchase, or by emailing founder@thier.app. Note that under EU/UK law you may lose the right of withdrawal where you expressly consent to digital content being supplied immediately and acknowledge that you lose the right of withdrawal once supply has begun — if you start using the paid Service during the trial / withdrawal window, that consent may apply.
Apple as merchant of record
Refunds for App Store purchases are handled by Apple via reportaproblem.apple.com. We can advocate on your behalf but cannot directly issue App Store refunds.
9. Intellectual property
Thier and its related content — including product design, text, branding, courses, podcast content, lesson content, and software — are owned by or licensed to Thier and are protected by applicable intellectual property laws. You may use the Service for personal, non-commercial use only, unless we give written permission otherwise.
10. Service availability
We aim to keep the Service available, but we do not promise uninterrupted or error-free operation. Features may change, be paused, or be removed as the product evolves. We may perform maintenance with or without notice.
11. Warranty disclaimer
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied. We disclaim all implied warranties including merchantability, fitness for a particular purpose, non-infringement, and accuracy of biological-age estimates, AI responses, lab inferences, or any other model output. We do not warrant that the Service will meet your requirements, that it will be uninterrupted or error-free, or that any defects will be corrected.
Nothing in these Terms excludes or limits any rights you have as a consumer that cannot be excluded under applicable law — including, in the United Kingdom, the Consumer Rights Act 2015 and, in the European Union, the Sale of Goods and Digital Content Directives.
12. Limitation of liability
To the fullest extent permitted by law:
- Thier (and its sole owner Steven Kippax personally) will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost data, or business interruption, even if advised of the possibility.
- Our aggregate liability for any direct loss arising from your use of the Service is limited to the greater of (a) the amounts you paid Thier for the Service in the 12 months immediately before the event giving rise to the claim, and (b) GBP 100.
- This limitation applies regardless of the legal theory (contract, tort including negligence, breach of statutory duty, or otherwise).
Carve-outs. Nothing in these Terms limits or excludes liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; (c) gross negligence; (d) any other liability that cannot be limited or excluded under applicable law — including non-excludable rights under the UK Consumer Rights Act 2015 and equivalent EU and member-state consumer-protection laws.
13. Indemnity
You agree to indemnify and hold Thier harmless against third-party claims, damages, and reasonable costs (including legal fees) arising from your breach of these Terms or your misuse of the Service. This does not exclude or limit any rights you have as a consumer.
14. Governing law and jurisdiction
These Terms, and any dispute arising out of or in connection with them or the Service, are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that:
- if you are a consumer resident in another part of the United Kingdom (Scotland, Northern Ireland), the courts of your home jurisdiction may also have jurisdiction over consumer disputes;
- if you are a consumer resident in the European Union, the law of your country of residence may give you additional protection that this clause does not override, and you may bring proceedings in the courts of your country of residence.
Thier is operated from Glasgow, Scotland; we use English law as the governing system because it is the standard choice for UK SaaS contracts.
15. Informal dispute resolution
Before starting any formal legal proceeding, please email founder@thier.app with a description of your concern so we can try to resolve it directly. Many issues are quickly fixable that way. This does not replace your statutory rights or any ombudsman / supervisory authority you may be entitled to contact.
16. Termination
You can terminate these Terms at any time by deleting your account (see the Privacy Policy for the in-app and manual paths). We can terminate or suspend the Service to you, with or without notice, in the cases listed in Section 4 above (suspected abuse, security risk, repeated content-moderation issues, or breach of these Terms). Sections 2, 6, 9, 11, 12, 13, 14, and 15 survive termination.
17. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. For material changes (changes to liability, billing, or your obligations), we will surface the change in-app on next launch. Continued use of the Service after such an update means you accept the revised Terms.
